The court has increasingly prioritized religious rights over other rights and public health, including in cases focused on LGBTQ+ rights, women’s health, and COVID-19 restrictions. The starkness of the textualist and originalist approach employed by Alito in the draft opinion (and apparently sanctioned by the conservative majority of the Court), belies a dark future for women’s rights and health.
